Terms and Conditions The agreement that governs your use of our services

These Terms & Conditions (the "Terms") form a binding agreement between MAGMA3C ("we", "us", "our") and the person or entity that orders, accesses or uses any of our services ("you", "the Client"). By placing an order, creating an account, or using any service, you confirm that you have read, understood and agreed to be bound by these Terms.

1. Definitions

"Service" means any hosting, domain registration, email, SSL certificate, licence, server, development or related product supplied by us. "Account" means your client account in this billing portal. "Content" means any data, files, code, text, images or other material you store, transmit or publish using the Service.

2. Eligibility & Account

  • You must be at least 18 years of age, or be acting for a legally registered entity, to order services.
  • You must provide accurate, current and complete information when registering, and keep it updated. Orders placed with false, incomplete or untraceable contact details may be cancelled without refund.
  • You are responsible for all activity under your Account, including activity by your staff, contractors or end-users, and for keeping your passwords and API credentials confidential.
  • Notify us immediately at the address in section 17 if you suspect unauthorised use of your Account.

3. Fees, Billing & Payment

  • All prices are shown at the point of order. Unless stated otherwise, prices are in Pakistani Rupees (PKR) and are exclusive of any applicable sales tax, GST, withholding tax or bank charges, which are payable by you.
  • Services are billed in advance for the full billing cycle you select (monthly, quarterly, semi-annually, annually or biennially).
  • Invoices are generated before the due date and sent to the email address on your Account. It is your responsibility to ensure invoices are received; non-receipt is not grounds for non-payment.
  • Payment is due on or before the invoice due date. We may apply a late fee and/or suspend services on overdue invoices in accordance with section 9.
  • Bank transfer, gateway and currency-conversion charges are borne by you. Where you pay by a method that deducts a fee, the amount received must equal the invoice total.
  • We may revise pricing at any time. Price changes will not affect a billing cycle already paid for, and we will give you reasonable notice before your next renewal.

4. Service Term & Renewal

  • Services begin when we activate them and continue for the billing cycle you selected.
  • Services renew automatically at the end of each cycle unless you cancel before the renewal invoice due date. Submit cancellations through your client area so they are recorded.
  • Cancellation requests received after a renewal payment has been taken are treated under our Refund Policy.
  • You may upgrade at any time; the price is pro-rated. Downgrades take effect at the next renewal and do not generate a refund of the difference.

5. Acceptable Use

You may not use the Service to host, transmit, link to or facilitate any of the following. This list is illustrative, not exhaustive.

5.1 Unlawful content and activity

  • Anything unlawful under the laws of the Islamic Republic of Pakistan, including the Prevention of Electronic Crimes Act 2016 (PECA), or under the laws of the jurisdiction where the content is accessed.
  • Material that infringes copyright, trademarks, patents or trade secrets, including pirated software, media, licence keys, cracks or warez.
  • Child sexual abuse material, content that sexualises minors, or pornography of any kind.
  • Content that incites violence, terrorism, sectarian or religious hatred, or that is blasphemous or defamatory.
  • Fraud, phishing, carding, money-laundering, pyramid or Ponzi schemes, fake pharmacies, fraudulent documents, or the sale of regulated goods without licence.

5.2 Network and security abuse

  • Sending unsolicited bulk email (spam), or hosting a site or service advertised by spam sent elsewhere.
  • Distributing malware, viruses, trojans, ransomware, keyloggers, exploit kits or botnet controllers.
  • Port scanning, penetration testing, brute-force attacks, denial-of-service attacks, or any attempt to gain unauthorised access to any system, whether ours or that of a third party.
  • Forging headers, spoofing IP addresses, or concealing the origin of any transmission.
  • Open relays, open proxies, open DNS resolvers, Tor exit nodes, or public VPN endpoints.
  • Cryptocurrency mining, or any process whose primary purpose is to consume CPU for external gain.

5.3 Enforcement

We investigate reported abuse. Where content is clearly unlawful or presents an immediate risk to our network, to other clients, or to third parties, we may remove it or suspend the Service without prior notice. In all other cases we will make reasonable efforts to contact you first. We are required to cooperate with lawful requests from the Pakistan Telecommunication Authority, the Federal Investigation Agency and other competent authorities.

6. Resource Usage

  • Shared and reseller hosting is sold on a fair-use basis. Resources are intended to support normal website operation, not sustained batch processing, file storage, streaming, or backup archiving.
  • Where published limits apply to CPU, memory, I/O, entry processes, inodes or concurrent connections, those limits form part of these Terms.
  • "Unlimited" or "unmetered" descriptions refer to the absence of a fixed numeric cap, not to unrestricted use. They remain subject to fair use and to the limits above.
  • If an account consistently degrades performance for others, we may throttle it, require an upgrade to a VPS or dedicated server, or suspend it. We will contact you before acting unless the impact is severe.

7. Backups & Your Data

  • Any backups we take are for our own disaster-recovery purposes and are provided to you as a courtesy only. They are not a backup service.
  • You are solely responsible for maintaining your own current, off-site backups of all Content. We give no warranty that a backup will exist, be complete, or be restorable.
  • You retain ownership of your Content. You grant us only the limited licence needed to host, transmit, copy and display it in order to deliver the Service.
  • After termination, we may permanently delete all Content associated with the Service. Request an export before cancelling.

8. Domain Names

  • Domain registrations are governed by the rules of the relevant registry — PKNIC for .pk domains, and ICANN together with the registry operator for generic and other country-code domains — and by the agreement of the registrar of record. Those rules take precedence over these Terms in respect of the domain itself.
  • Domain fees are passed through to the registry and are non-refundable once the registration, transfer or renewal is submitted, including where a website is never built.
  • Registration is not guaranteed until confirmed by the registry. If a registration fails, we refund the domain fee in full.
  • You are responsible for renewing your domain on time and for keeping its contact details and nameservers accurate. Domains that expire may enter redemption, which carries a substantial registry fee, or may be released and registered by a third party.
  • Providing false WHOIS data, or failing to respond to a registry verification email, can result in the domain being suspended by the registry. We cannot reverse this.

9. Suspension & Termination

  • Non-payment. Services may be suspended after an invoice becomes overdue, and terminated with all data deleted if it remains unpaid. A reactivation fee may apply. We will send reminders to the email address on your Account before suspending.
  • Breach. We may suspend or terminate immediately and without refund for any breach of section 5, for conduct that exposes us to legal liability, or for abusive behaviour towards our staff.
  • By you. You may cancel any service at any time through your client area. Cancellation takes effect at the end of the paid cycle unless you request immediate termination.
  • Sections 7, 11, 12 and 16 survive termination.

10. Availability & Support

  • We aim for high availability but do not warrant that the Service will be uninterrupted or error-free.
  • Scheduled maintenance is announced in advance where practicable. Emergency maintenance may be carried out without notice.
  • Downtime caused by your own code, plugins, misconfiguration, exceeded resource limits, expired domains, third-party outages, or events outside our reasonable control does not count towards any availability commitment.
  • Support is provided through the ticket system in your client area. Support covers our infrastructure and the services we supply; it does not include developing, debugging or maintaining your own applications unless separately contracted.

11. Limitation of Liability

To the fullest extent permitted by law:

  • The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability and fitness for a particular purpose.
  • We are not liable for loss of profit, revenue, goodwill, business opportunity, or for any indirect, incidental, special, punitive or consequential loss, however arising.
  • We are not liable for loss of or damage to data, or for the cost of recovering it.
  • Our total aggregate liability for any claim is limited to the amount you actually paid us for the affected service during the three (3) months immediately preceding the event giving rise to the claim.

Nothing in these Terms excludes liability that cannot lawfully be excluded.

12. Indemnity

You agree to indemnify and hold harmless MAGMA3C, its directors, employees and suppliers against any claim, demand, loss, damage, fine or expense (including reasonable legal fees) arising out of your Content, your use of the Service, or your breach of these Terms or of any law.

13. Third-Party Services

Delivering the Service requires third parties — datacentres, upstream networks, domain registries and registrars, certificate authorities, payment gateways, email delivery providers and software vendors. Their products are supplied subject to their own terms. We are not responsible for their acts, omissions, outages, price changes or discontinuation of a product, though we will make reasonable efforts to assist you.

14. Privacy

Our handling of your personal data is described in our Privacy Policy, which forms part of these Terms. Refunds are governed by our Refund Policy.

15. Changes to these Terms

We may update these Terms from time to time. The current version is always published at this URL with the date it was last updated. Material changes will be announced in the client area or by email. Continuing to use the Service after a change takes effect constitutes acceptance of the revised Terms.

16. Governing Law & Disputes

These Terms are governed by the laws of the Islamic Republic of Pakistan. The parties will first attempt to resolve any dispute in good faith through the support ticket system. Failing that, the courts at Lahore, Punjab, Pakistan have exclusive jurisdiction.

If any provision of these Terms is held unenforceable, the remaining provisions continue in full force. Our failure to enforce a provision is not a waiver of it.
